Official Contest Rules (the “Rules”)

This Lindt GOLD BUNNY Easter AR Exp (the “Contest”) is sponsored by Lindt & Sprüngli (Canada), Inc. (“Lindt” or the “Sponsor”).

 

EXPERIENCE: Scan the QR code for the In Person Augmented Reality (“IP-AR”) experience in Toronto (Bay Street and Front Street area), Vancouver (Science World Area), and Montreal (Place des Arts Area), and At-Home Augmented Reality (“AH-AR”) experience.

 

ELIGIBILITY:

 

This Contest is open to residents of Canada who post their self created content of the IP-AR and/or the AH-AR experience and who have reached the age of majority in their province/territory of residence at the time of entry. Employees, representatives and agents of the Sponsor, and each of its affiliates, subsidiaries, franchisees, advertising and promotional agencies, fulfillment houses, the Contest judges and members of their respective immediate families or those with whom they are domiciled, are not permitted to enter the Contest. In these Rules, “immediate family” means mother, father, brothers, sisters, sons, daughters, and legal or common-law spouse, regardless of where they reside. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate.

 

HOW TO ENTER:

 

The Contest starts on March 11th , 2024 at 9:00am Eastern Time (“ET”) and ends on March 31st , 2024 at 11:59:59 p.m. ET (the “Contest Period”). Limited to one (1) entry, per person, each day of the Contest Period.

 

NO PURCHASE NECESSARY.  To enter the Contest, visit the IP-AR between the hours of 12pm – 6pm, in Toronto, Ontario, Montreal, Quebec, or Vancouver, British Columbia, OR utilize the AH-AR experience from anywhere in Canada, during the Contest Period and scan the QR code, take a screen shot or recording of the IP-AR or the AH-AR experience, upload onto Instagram Stories of your Account, tag and follow @LindtCanada. Instagram account must be public in order to be eligible.

 

The Sponsor will not be responsible for late, lost, misdirected, stolen, ineligible, destroyed, incomplete or delayed Entries. Proof of submitting an Entry is not proof of receipt.

 

DESCRIPTION OF PRIZE:

 

Contest Period prizing consists of ten (10) Lindt Canada gift cards that can only be redeemed on Lindt.ca to purchase Lindt products, each in the amount of $150 CAD (the “Prize”).

A random draw will take place on Friday April 5th at approximately 2:00pm at the Lindt central office, 181 University Avenue, Suite 900, in Toronto, Ontario, to select ten (10) winners from among all eligible entries received during the Contest Period for the Prize.

 

 

ODDS OF WINNING:

 

The odds of winning the Prize depend on the total number of Entries received during the Contest Period.

 
GENERAL PRIZE INFORMATION:
The Prize must be accepted as awarded and cannot be transferred or exchanged for cash or any other value. The Sponsor reserves the right to substitute all or any part of the Prize for a prize or prizes of equal or greater value, at its sole discretion. Should the Prize (or any part or aspect of the prize) be unavailable for any reason, the balance of the Prize will be awarded in full satisfaction of the Prize, and the Sponsor shall not be required to replace the unavailable component. Any unused portion of the Prize is forfeited and has no cash value.

To be declared a winner and claim the Prize, a participant selected must be eligible according to these Rules. In addition, the potential winner must:

a.     Be reached (by Instagram Direct Messages) by the Sponsor or its representatives within forty-eight (48) hours following the selection or draw date.

b.     If applicable, correctly answer a mathematical skill-testing question, without assistance, to be administered by the Sponsor or its representatives at a mutually convenient time; and

c.     Complete and sign a Declaration of Compliance and Release Form (“Release”) confirming compliance with these Rules and releasing the Sponsor and its affiliates, agencies, contest prize suppliers and their respective officers, directors, employees and agents (collectively, the “Contest Group”) from all liability with respect to the potential winner’s participation in the Contest and the awarding or use of the Prize, and return it to address indicated by the deadline indicated in the letter accompanying the Release.

 

All prize claims are subject to verification of entrant eligibility and compliance with these Rules. All selected entrants whose eligibility cannot be confirmed under these Rules shall be disqualified. If a selected entrant cannot be reached within the forty-eight (48) hour period, fails, if required, to correctly answer the mathematical skill-testing question in the manner prescribed, fails to return the Release within the required timeframe or otherwise is not in compliance with these Rules, they will be disqualified and will forfeit the Prize; and the Sponsor can, at its sole and absolute discretion, select another eligible entrant and attempt to reach this entrant, who will also be subject to the same qualification Rules. Each selected entrant may be required to show proof of identification as part of the confirmation process. In case of a dispute concerning the identity of the individual who submitted an Entry, the authorized account holder of the Instagram Account submitted at the time of Entry will be deemed to be the participant. For the purposes of these Rules, “authorized account holder” of an Instagram Account is defined as the natural person who is assigned to an account by Meta.

 

Refusal by a selected entrant to accept the Prize as described and according to the conditions of these Rules will release the Sponsor of all obligations relating to this Prize for this entrant and Sponsor may, in its sole discretion, select an alternate entrant to receive the Prize. Confirmed winners will be notified of how to claim their Prize and the Prize will be delivered. The Sponsor will not be responsible for failed attempts at contacting a selected entrant.

 

GENERAL RULES: 

 

The Sponsor reserves the right, at its sole discretion and at any time without prior notice, to rescind, amend or suspend all or part of this Contest (or to amend these Rules) for any reason including in the event of an incident, virus, bugs or any human intervention that could corrupt or affect the administration, security, impartiality or normal flow of this Contest. Sponsor is not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or deleted computer or network transmissions which may limit the ability to participate in the Contest.  In no event will Sponsor be required to award more prizes than the number stipulated in these Rules or award prizes other than those described in these Rules.

 

By participating in this Contest, each entrant accepts and agrees to abide by these Rules and all decisions of the Contest judges (who may be employees, agents or independent contractors of the Sponsor), which shall be final and legally binding on the entrant in all matters relating to this Contest, including without limitation eligibility and/or rejection of an Entry. All Entries become the property of the Sponsor and will not be returned.

 

All Entries are subject to verification by the Sponsor and the Sponsor reserves the right to cancel and revoke any Entries if they are found to be improper, fraudulent, forged, incomplete or tampered with or if the entrant is subsequently found to be ineligible pursuant to the Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

 

By entering this Contest, each entrant acknowledges and agrees that the Contest Group: (i) shall have no liability of any kind whatsoever with respect to this Contest, the entrant’s participation therein, and/or the awarding, use, misuse, or participation in the Prize; (ii) makes no guarantee or representation of any kind concerning the Prize; (iii) disclaims any implied warranty or condition concerning the Prize; and (iv) is not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance, use, misuse, or participation in the Prize or otherwise from such entrant’s participation in this Contest, including any injury or damage which may be caused directly or indirectly, in whole or in part, from downloading. The Contest Group is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Rules, the selection and announcement of the winner or the distribution of the Prize.

 

For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. For residents of Quebec, any litigation regarding the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. This Contest is subject to all applicable federal, provincial/territorial, and municipal laws, and void where prohibited.

 

Personal information collected from entrants will be used by the Sponsor to administer the Contest and otherwise in accordance with Sponsor’s privacy policy available online at https://www.lindt.ca/en/privacy-notice.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and the disclosures or other statements contained in any Contest-related materials, including, but not limited to: a French version of these Rules, and/or point of sale, television, print or online advertising, the terms and conditions of these English Rules shall prevail, govern and control.
